Terms and Conditions for The Journalism School Limited for the Booking by the customer (“you”).

Please read the following Terms carefully before placing an order or booking a class with The Journalism School Limited.

The Journalism School Limited reserves the right to amend these Terms at any time.

Bookings

The Journalism School Limited offers courses, classes and lessons (“Classes”).

Bookings for Classes

(“Bookings”) are taken and constitute a contract between you and The Journalism School Limited.

A Booking is not secured until:

full payment has been made by you;

and you have received an email from The Journalism School Limited confirming your Booking (“Confirmed Booking”).

The Journalism School Limited will not hold Bookings before payment has been made. It is your responsibility to ensure that you have made your Booking, including payment, correctly.

You may make a Booking for yourself or on behalf of another person/other people (“Other Attendee”). If you make a Booking for an Other Attendee, you must ensure that you inform The Journalism School Limited of the Other Attendee’s name and email address.

All information regarding Confirmed Bookings that you have made, whether for yourself or an Other Attendee shall be sent to you rather than the Other Attendee if you do not provide the Other Attendee’s details.

Cancellation and Refunds

You have the right to cancel your Booking and obtain a refund of the Confirmed Booking for 14 days from the day on which you make a Booking, unless your Booking relates to a Class which begins before the expiry of that period, in which case your right to cancel and obtain a refund will expire when the Class begins. If you exercise your right to cancel your Booking, you will receive a refund within 30 days of such cancellation.

Confirmed Bookings are otherwise non-refundable and cannot be cancelled or moved, even if you are unable to attend. If you can find someone else to attend in your place, you must inform The Journalism School Limited of the replacement attendee’s full name and email address.

Mistakes made by you with regard to Class dates or Class locations will not constitute grounds for cancellation.

The Journalism School Limited reserves the right to cancel a Class. In the event of such cancellation, The Journalism School Limited will contact you by e-mail and / or telephone and offer you the choice of: a refund of the Confirmed Booking; or transfer to an alternative Class.

The Journalism School Limited will not be liable to you for any other costs or expenses that you may incur in the event that the Provider cancels a Class.

Notwithstanding anything else in these Terms, in exceptional circumstances The Journalism School Limited may reschedule a Class or provide a refund or part refund, solely at its discretion.

Arrive on Time

You must ensure that you arrive on time for your Class. If you are late, the teacher/trainer may not let you in and you will not be entitled to a refund of your Confirmed Booking.

Classes shall take place at the location set out on your Confirmed Booking email, however this location may be subject to change. In the event that the location of the Class changes, The Journalism School Limited will endeavour to contact you by email and/or phone to inform you of the new location.

Class Content

The Journalism School Limited reserves the right to change the Class content at any time.

Force Majeure

The Journalism School Limited shall not be liable to you or deemed to be in breach of these Terms by reason of any delay in performing or any failure to perform any of its obligations in relation to these Terms, if the delay or failure was due to any cause beyond its reasonable control, including, but not limited to: acts of God, explosion, flood, tempest, fire or accident, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T. viruses, difficulties in obtaining raw materials, labour, fuel, parts or machinery, power failure or breakdown in machinery.

Liability

To the maximum extent permissible in law, The Journalism School Limited excludes all liability for any indirect, additional or consequential loss or any kind however incurred by you, arising in connection with these Terms.

The maximum liability of The Journalism School Limited for any direct loss will be not more that the price paid by you for the Confirmed Booking.

Nothing in these Terms excludes or limits the The Journalism School Limited’s liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) breach of any obligation implied by statutory law which cannot lawfully be excluded.

Waiver

No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate as a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. To be effective, any waiver must be in writing.

Severability

If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.

Entire Agreement

These Terms together with the Confirmation Booking email constitute the entire agreement between you and The Journalism School Limited and shall have effect to the exclusion of any other memorandum, agreement, or understanding of any kind, whether oral or written, between the parties hereto and touching and concerning their subject matter.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with English law and the parties hereby agree to submit to the exclusive jurisdiction of the English courts.
